California’s FAIR Plan is the state’s insurer of last resort — the policy homeowners are supposed to rely on only when no private carrier will write them.

That’s the theory.

In practice, it has become the default across many of the ZIP codes where I sell.

According to state figures cited by Stanford researchers and the California Department of Insurance, FAIR Plan policies grew roughly 152%, from about 270,000 in 2022 to more than 680,000 by March 2026.

It now backs somewhere around 5% of the state’s single-family homes, up from under 2% in 2020.

Statewide, more than one in every 17 new California home loans is now written with the FAIR Plan as the only available option.

A program built to be the exception has increasingly become the rule.

Why This Hits the Luxury Market Hardest

Here’s the twist that many of the headlines buried.

In July, Insurance Journal and Claims Journal reported that high-value enclaves — including Beverly Hills, Malibu, and Bel Air — now make up a disproportionate and fast-growing share of the FAIR Plan’s total risk exposure.

Regulators worry that this concentration could strain the entire program.

And here’s the catch for anyone buying at the top of the market:

The FAIR Plan caps residential dwelling coverage at $3 million.

If you’re closing on a $15 million estate in the hills, a $3 million cap doesn’t rebuild the primary suite, let alone the entire house.

So luxury buyers are increasingly forced to stitch together multiple layers of coverage:

FAIR Plan coverage + Difference in Conditions (DIC) policy + excess coverage.

Three policies doing the job that one policy used to do.

That means more paperwork, higher premiums, and more opportunities for a transaction to wobble during escrow.

The New Number Landing This Fall: 29.1%

This is the development luxury buyers and sellers need to understand now.

The California Department of Insurance approved a roughly 29% FAIR Plan rate increase — 29.1%, to be exact — taking effect for new and renewal business beginning October 15, 2026.

That increase lands on top of a market where average California home-insurance premiums are already up about 84% since 2020, according to Stanford research.

For a fire-zone estate, insurance is no longer a rounding-error closing cost.

It can be a monthly expense large enough to change a buyer’s entire price ceiling.

I’ve watched a surprise insurance premium quietly erase six figures of purchasing power on a home a client already loved.

That changes the negotiation.

What This Actually Means for Luxury Buyers

I don’t just list properties. I position them.

And in 2026, positioning means getting ahead of the insurance conversation before it ambushes escrow.

If you’re buying, get an insurance quote before you’re in contract — not deep into your contingency period.

I have clients pull a binder estimate the same week they tour a property.

Knowing your real all-in monthly cost upfront protects both your budget and your negotiating leverage.

A buyer who already understands the insurance picture negotiates from a position of strength instead of scrambling after the contract is signed.

What This Means for Sellers

If you’re selling a property in a brush or fire zone, don’t wait for the buyer to discover the insurance problem.

Get ahead of it.

Pre-shop the property for insurance and understand what coverage may be available before you hit the market.

A seller who can provide buyers with a clear insurance story removes one of the biggest sources of uncertainty in today’s luxury transactions.

And while you’re at it, look seriously at hardening the home.

Class-A roofing. Ember-resistant vents. Defensible space. Other appropriate wildfire-mitigation measures.

Because sophisticated buyers are no longer underwriting a property based solely on location, architecture, views, and price per square foot.

They’re underwriting insurability.

A home that carriers are willing to insure has a meaningful advantage over an otherwise comparable property that they won’t touch.

Insurability Is Becoming Part of the Asset

The buyers and sellers winning in this market aren’t necessarily the ones with the most cash.
